The Garden City Commission unanimously passed a new nudity ordinance last week that prohibits all forms of unsanctioned public nudity.
The ordinance, drafted by City Counselor Randy Grisell with the guidance of City Prosecutor James Dummermuth, was created in response to a legislative gap that made it difficult for nudity charges to be prosecuted in cases of public indecency.
The ordinance defines nudity as “showing of the human male or female genitals, anus, anal cleft or anal cleavage, or the showing of the female breast below a horizontal line across the top of the areola at its highest point with less than a fully opaque covering.”
There are no federal laws prohibiting public nudity, it even may be protected under the First Amendment right to freedom of expression.
