City files motion to dismiss lawsuit that seeks to end employment of new, interim fire chief

Former Topeka City Councilman John Alcala lacks the legal standing to pursue a lawsuit he filed against the city because his lawsuit petition failed to show how the city’s actions might personally injure him, the city contends in a motion seeking to dismiss the case.

The motion adds that Alcala’s claim that Kansas declaratory judgment statutes give him standing to pursue the case must be rejected because “no justiciable case or controversy” exists between the parties involved.
